PACIFIC GROVE, Monterey County — October 23, 2026. A Pacific Grove property advertised as a vacation rental may not be eligible for a new short-term rental permit. Under Pacific Grove Municipal Code Chapter 7.40, the city sets a maximum of 250 short-term rental licenses and imposes proximity limits on newly licensed properties. Separate land-use rules also restrict transient use in residential zones. Anyone buying a property on the assumption that rental income will cover the mortgage should confirm parcel-specific eligibility with the city before signing a contract.
What does the 55-foot rule mean?
The city’s code says a new short-term rental must generally be outside a 55-foot zone of exclusion measured from an already-licensed STR parcel boundary. If any part of a proposed parcel falls in that distance, it can be ineligible, with narrowly described conditions concerning some flag-lot access easements. Rules also limit each parcel to one licensed STR. A property physically near the coast is not automatically permitted to operate as a full-time vacation home.
What happens when the city reaches the cap?
The chapter sets a maximum of 250 licenses. If the existing licensed total meets or exceeds that ceiling, new applicants may be placed on a waiting list. The city’s program also includes neighborhood density rules and an earlier lottery process for some incumbent license holders. The number of listings shown on travel platforms cannot substitute for the current city register of active licenses.
Does the permit transfer if the home is sold?
Generally no. The municipal code states that STR licenses are nontransferable upon property sale or transfer, apart from an exception for certain transfers between spouses. An investor cannot value an untransferable old license as if a new owner would automatically inherit it. A seller’s statements should be checked against current city documentation and any Coastal Zone requirements.
What are the operating conditions?
The city limits adult overnight occupancy to two people per bedroom plus one additional adult per unit, subject to its actual license determination. It also requires an owner or designated local manager who can physically respond to a call within 30 minutes. License numbers, permitted occupant totals and vehicles must be displayed, and local transient occupancy tax must be properly reported.
Is annual renewal guaranteed?
No. The code says that an STR license without another displayed expiry date expires March 31, and renewal is not automatic. Owners must provide updated documentation, safety inspection reports, listing links and tax compliance information. Repeated violations and failure to meet renewal criteria can lead to denial or suspension.
